1. Acceptance of terms
By activating, using, or paying for any New Rock Wireless services, you agree to be bound by these Terms of Service. This includes any changes or updates made to these terms from time to time. 2. Services and coverage
New Rock Wireless provides mobile communication services, including voice, text, and data, using the network of a third-party wireless carrier. We do not guarantee uninterrupted or error- free service and are not liable for any issues arising from the underlying carrier's network. Service availability, quality, and speeds are not guaranteed and may vary due to location, network capacity, and other factors.
3. Account and eligibility
Account responsibility: You are responsible for all activity on or through your New Rock Wireless account. You must ensure that your account information and password are secure.
Eligibility: You must be of legal age to form a binding contract. If you are not, you must have your parent or guardian agree to these terms on your behalf.
Prohibited use: You agree not to use our services for any unlawful, fraudulent, or abusive purpose. Prohibited activities include spamming, unauthorized advertising, or any activity that jeopardizes the security of our network or other users.
4. Billing and payment
You agree to pay all charges for your account, including recurring service fees, overage charges, and other fees. You must provide accurate billing information and authorize New Rock Wireless to charge your payment method. Late payments may incur fees and lead to service suspension or termination, and delinquent accounts may be sent to collections. Fees already paid are generally non-refundable.
5. Your device
Your device must be compatible with our network and comply with FCC regulations. We may update your device's software remotely and without notice, which could affect data or usage. For services using a SIM card, you acknowledge New Rock Wireless owns the intellectual property and software within it, which may also be changed remotely.
6. Termination of service
You can terminate your service by contacting us, but paid recurring fees are not refundable. We can suspend or terminate your service and account for various reasons, including non- compliance with terms, illegal activity, or harmful behavior, which may result in data loss.
7. Limitation of liability and disclaimer of warranties
New Rock Wireless services are provided "as is" and "as available" without warranties. To the extent permitted by law, we are not liable for indirect or consequential damages from using our services. Our total liability is limited to the amount paid for services in the previous month.
8. Indemnification
You agree to protect New Rock Wireless from claims, damages, and expenses related to your use of services, violation of terms, or infringement of rights.
9. Governing law and dispute resolution
This agreement is governed by your state's laws. Disputes will be settled through binding arbitration.
